Terms and Conditions of the Promotion

THE RULES OF “WOSEBA – Sets” PROMOTIONS.

1. These rules set out the general conditions and terms under which the promotion “WOSEBA – Sets” (hereinafter: the “Promotion”) is carried out by P.P.U.H. WOSEBA SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ based in Odolanów via websit woseba.pl (hereinafter: the: „Website”).

Article 1 – Definitions

1. Customer – means an entity to the benefit of which services may be provided by electronic means in accordance with the Rules and Regulations or with which a Contract of Sale may be concluded.
2. Rules – mean these rules of the Promotion.
3. Rules of the Online Store – mean the rules of the sale and provision of services by electronic means, available on the website of the Online Store.
4. Online Store – an online store operating on the domain: woseba.pl, owned by P.P.U.H. WOSEBA SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ based in Odolanów.
5. Seller (Organiser) – means P.P.U.H. WOSEBA SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in Odolanów (63-430), ul. Krotoszyńska 150, NIP (tax identification number): 6220006580, REGON (statistical number): 003376160, BDO: 000063982, entered in the register of entrepreneurs kept by the District Court Poznań – Nowe Miasto i Wilda in Poznań, 9th Economic Department of the National Court Register under the KRS number 0000013901, with the share capital of PLN 150,480; e-mail: sklep@woseba.pl, which is also the owner of the Online Store.
6. Store Website – means the websites by means the Organiser operates the Online Store, operating on the domain: woseba.pl. On the Store Website it is possible to make a purchase and conclude a Sales Contract with the Vendor, also to benefit from the Promotion.
7. Promotional “Set” – means a set of several goods, the total gross price of which within the scope of the Kit presented by the Vendor via the Store’s Website: http://woseba.pl/kategoria-produktu/promocje/ is lower than in the case of purchasing individual unit goods, included in the Set, without the Promotion (i.e. purchasing the same goods, but outside the Set). The list of Promotional Sets valid from 02.04.2024 until and including 30.04.2024, or until stocks are exhausted, together with information how much the gross price of the Set is reduced in comparison with the total gross price of the same goods purchased separately (outside the Set) – i.e. not subject to the Promotion, is attached as Appendix no. 1 to these Rules.
8. Promotion Participant – means a Customer who has fulfilled the conditions defined in the Rules.
9. Contract of Sale – means a distance contract of sale, on the terms and conditions set out in the Rules of the Online Shop, between the Customer and the Seller.

Article 2 – General Terms

1. The organiser of the Promotion is P.P.U.H. WOSEBA SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in Odolanów (63-430), ul. Krotoszyńska 150, NIP (tax identification number): 6220006580, REGON (statistical number): 003376160, BDO: 000063982, entered in the register of entrepreneurs kept by the District Court Poznań – Nowe Miasto i Wilda in Poznań, 9th Economic Department of the National Court Register under the KRS number 0000013901, with the share capital of PLN 150,480; e-mail: sklep@woseba.pl, which is also the owner of the Online Store.
2. The Promotion takes place from 02.04.2024 to 30.04.2024, or until the stocks are exhausted.
3. The contents of these Promotion Rules are available on the Store Website, at: http://woseba.pl/regulamin-promocji/

Article 3 – Terms and conditions of participation in the Promotion

1. The Participant in the Promotion may be any Customer of the Online Store, who has full legal capacity, and who, during the period of the Promotion, meets all of the following conditions: he/she adds a Promotional Set or Promotional Sets to the “Basket”, which are included in the offer of the Online Shop, marked as sets participating in the Promotion, accepts these Rules and the Rules of the Online Store, by marking the appropriate fields in the order form and concludes a Contract of Sales with the Promotional Set(s) as the subject. Detailed rules for concluding Contracts of Sales and making payments are included in the Rules of the Online Store.
2. This Promotion is not combined with other promotional actions, however, it is combined with free shipping above the gross amount of PLN 150.
3. During this Promotion, the Customer may paticipate in it multiple times (any number of times), after meeting each time the conditions of participation in the Promotion as set out in these Rules.
4. Participation in the Promotion is voluntary.

Article 4 – Complaints

1. A Participant may lodge a complaint with the Organiser as regards its participation in the Promotion. A complaint can be lodged, for example, in electronic form and sent to the Organiser’s e-mail address: sklep@woseba.pl. The Participant should include a description of the problem in the complaint. The Organiser shall promptly, but not later than within 14 (fourteen) days, consider the complaints and respond to the Participant’s e-mail address provided in the complaint.
2. The principles of execution of the Participant’s rights under statutory warranty for physical or legal defects in the Goods are included in § 7 of the Rules of the Online Store. The provisions of these Rules neither affect nor limit the Participant’s rights under statutory warranty according to the applicable legislation.
3. The Organiser does not make use of the out-of-court dispute resolution referred to in the Act of 23 September 2016 on out-of-court resolution of consumer disputes

Article 5 – Withdrawal from a Distance Contract of Sales

1. The principles governing the execution of the consumer’s right of withdrawal from a distance contract are included in § 8 of the Rules of the Online Store. The provisions of these Rules neither affect nor limit the Participant’s right ti withdraw from a distance contrct of sales according to the applicable legislation.

Article 6 – Personal data protection

1. The rules for the protection of personal data of all Customers (including Promotion Participants), are set out in the Privacy Policy, available on the website of the Online Store: https://sklep.woseba.pl/polityka-prywatnosci.

Article 7 – Final provisions

1. The contents of these Regulations may be recorded by being printed, copied to a storage device or downloaded at any time from the Shop Website.
2. Should a dispute arise under these Rules, the parties will seek to resolve the matter amicably. All disputes arising from these Rules shall be solved in compliance with the Polish law.
3. The Seller informs the Customer, being the Consumer, of the possibility of taking advantage of out-of-court means of settling complaints and obtaining redress. Rules of access to such procedures are available at the offices or on the internet sites of the entities responsible for out-of-court settlement of disputes. These may be in particular Consumer rights spokespersons or the Voivodship Inspectorate of Trade Inspection, the list of which is available on the internet site of the Office of Competition and Consumer Protection at the address http://www.uokik.gov.pl/spory_konsumenckie.php.
   The Seller provides information that at the address http://ec.europa.eu/consumers/odr/ there is available the platform of an online system of settling disputes between consumers and businesspersons at the EU level (the ODR platform).
4. The list of Promotional Sets valid from 02.04.2024 until and including 30.04.2024, or until the stocks are exhausted, is attached as Appendix no. 1 to these Rules.
5. Matters not regulated by these Rules shall be governed by the provisions of Polish law, including in particular the Act of 30 May 2014 on Consumer Rights (consolidated text in Journal of Laws 2020, item 287, as amended) and the Civil Code of 23 April 1964 (consolidated text in Journal of Laws 2022, item 1360, as amended) and the provisions of the Rules of the Online Store, which the Participant accepts when placing an order.
6. The Regulations shall come into force on 09.04.2024.
